GAY ART GALLERY ARTIST CONTRACT The following is an agreement between Gay Art Gallery, [ headquartered in the USA, operating as an online art gallery on the World Wide Web] and ____________________________, an artist submitting works of art to be exhibited on Gay Art Gallery's website, for the purpose of sale to the public. PLEASE READ EVERYTHING IN THIS CONTRACT AND BE CERTAIN YOU UNDERSTAND AND AGREE TO ALL ITS PROVISIONS. ------------------------------------------------------------------------------------------ 1 Submission of Artworks a An artist should submit artworks for exhibit by e-mail if possible, or by copies through regular mail. If you want items returned, you must send a stamped self-addressed envelope. b Computer files from a scanner or digital camera should be in a format compatible with the hardware and software used by Gay Art Gallery (jpgs are preferred). Images thus submitted should be of adequate quality for display online. c Gay Art Gallery can scan flat items that are up to 8 by 11 inches in size. 2 Pricing of Artworks and Other Items a Pricing of artworks for sale of Gay Art Gallery will be jointly determined by the artist and Gay Art Gallery. The artist should include Gay Art Gallery's commission (35%) in prices asked. (Do not add 35% to the amount you want to receive - the mathematics do not work that way) b The artist will not sell the same item(s) on his/her own website, or on any other website, at a lower price than is listed on Gay Art Gallery. c If the artist sells comparable work on another website, Gay Art Gallery reserves the ability to alter those prices, or alter the type of works sold on Gay Art Gallery. An example would be a limited edition offered only by Gay Art Gallery. d Works shown on Gay Art Gallery must not be listed on eBay. 3 Information a The artist shall furnish to Gay Art Gallery information necessary to provide a complete gallery presence. This information may include the artist's biography or resumé‚ and the artist's statement or philosophy concerning his/her art in general, and/or on the specific works being shown. b Please tell Gay Art Gallery if your personal contact information changes. c The artist will furnish all requested caption information for artworks exhibited (see end of contract). d If your work also appears on your own or another website, please add Gay Art Gallery to any list of links and list of your exhibits. 4 Gallery Sales a Gay Art Gallery does not guarantee the sale of any items exhibited. b Artist galleries will be designed and assembled by Gay Art Gallery. Gay Art Gallery will make final selections for all gallery exhibits. c Galleries will remain on the website for varying amounts of time, as determined by Gay Art Gallery. 1 Galleries
may remain up until the
artist or Gay Art Gallery decides to take them down. d Replacing damaged or unacceptable items returned from customers shall be the joint responsibility of the artist and Gay Art Gallery. A guarantee and return policy is stated on the website. e The artist must advise Gay Art Gallery immediately if a work is sold through another venue. 5 Delivery and Shipping a Original artworks being sold on Gay Art Gallery can be delivered to a purchaser directly by the artist with Gay Art Gallery packing slips and mailing labels only, or delivered by Gay Art Gallery. b Items must be delivered immediately upon receipt of Gay Art Gallery packing slip and mailing label, or in the case of items made to order, as soon as possible. 6 Commissions and Payments a The commission for artworks for sale on Gay Art Gallery is thirty five percent (35%). That amount will be taken from the price of the artworks listed on Gay Art Gallery. b The amounts of purchase prices on sold works, plus shipping costs paid by the artist, and less Gay Art Gallery's commission, will be paid by check to the artist after purchaser payment clears, and as soon as delivery to the buyer is confirmed. c Artists outside the United States may choose to be paid by American currency or by payment to your credit card (VISA or Mastercard only) d Artists will be charged a $US25 fee to exhibit their works if they are selling the same works on their own website. This applies to individual galleries, and not for works shown in group exhibits. See payment information at top of page. And if you have made your check out to Gay Art Gallery, tear it up and start again according to our instructions. 7 Publicity a The artist should do as much publicity as possible for his/her work appearing on Gay Art Gallery. b Information and images of artworks submitted by the artist to Gay Art Gallery may be used for publicity for Gay Art Gallery and its exhibits, unless otherwise requested. c Publication quality scans must be supplied upon request. d Copyright notice will appear with all images used for publicity purposes. Copyright warning will be part of all press release information. 8 Copyright of Artworks a Copyrights on all works of art submitted to or displayed on Gay Art Gallery are presumed to belong to the artist who is party to this agreement b A copyright notice indicating that artists hold the copyrights to their works is on the home page of the Gay Art Gallery website. c Copyright notices will be placed on all enlarged images, and elsewhere according to the request of the artist (on the gallery page, with caption information). 9 Miscellaneous a Artists will not make contact with customers without prior permission from Gay Art Gallery. b If you will be on vacation or travelling for any length of time, please let us know in advance.
